Advertising, Marketing & Distribution Practices

Our team regularly advises clients on how best to structure advertising and promotional campaigns to comply with the Competition Act, the Criminal Code, the Consumer Packaging and Labeling Act and the Personal Information Protection and Electronic Documents Act, among others.

With increasing enforcement in this area, we also represent clients in high profile litigation cases, including acting for Rogers Communications in respect of a misleading advertising case initiated by the Commissioner of Competition following a complaint by an industry competitor.

Members of our group also advise clients with regard to conduct such as:

  • terminating, refusing or limiting supply to distributors or dealers;
  • minimum resale/advertised pricing policies;
  • low pricing policies (predatory pricing);
  • bids and tenders;
  • tied selling and exclusive dealing policies; and
  • grey marketing.

We represent clients in both initiating and responding to inquiries by the Competition Bureau, the Attorney General, Advertising Standards Canada and the Régie des alcools, des courses et des jeux.
