Contaminated Sites

Members of our Environmental group are experts at resolving liability issues associated with contaminated sites and their redevelopment. We have excellent working relationships with technical experts and regularly advise on investigation and remediation strategies. We co-ordinate brownfield remediation projects, including facilitating communications with stakeholders (such as employees, neighbours and regulatory authorities).

Many sites we deal with have typical contaminants of concern such as hydrocarbons, volatile organic compounds and metals, but we also have extensive experience advising on complex sites impacted with polychlorinated bi-phenyls, herbicides, chlorinated solvents and radioactive substances. We have advised on the closure of waste disposal sites and mine tailings facilities and on the redevelopment of various historic infill areas such as ports and railway lands.

Our lawyers are skilled at defending against clean-up orders and negotiating practical solutions in the face of regulatory action. We advise in disputes regarding contaminated sites and contamination of municipal aquifers, whether based in statute, tort (including negligence, nuisance, trespass, Rylands v. Fletcher) or contract.
