Our expertise, experience and resources have proven to be invaluable in dealing with a variety of situations, including search & seizures, computer searches, production orders, orders to testify, wiretaps, commissions of inquiry, internal investigations, international asset tracing, director/officer liability claims, and related class actions. Whether negotiating with the governments or litigating against it, the key to our success is our experience. Our nationally recognized group has extensive trial and appellate experience at all levels of courts in every province and in the Supreme Court of Canada. Several of our litigators are former Crown prosecutors. Three of our litigation partners are fellows of the American College of Trial Lawyers. Two have been awarded the distinction of Advocatus Emeritus, one of the highest distinctions awarded by the Barreau du Québec.
We have extensive experience working with government attorneys and know how Crown prosecutors investigate and make charging decisions. We know how to effectively engage government investigators in negotiations and have had considerable success in convincing the government not to file criminal charges or to dismiss criminal charges and accept alternative dispositions after cases have been filed. In cases where dismissal of criminal charges is not an option, we assist clients in evaluating the risks in going to trial and when necessary will try cases on their behalf.
Our team also regularly provides advice and assistance to boards of directors in connection with internal or external investigations arising, for example, from allegations of wrongdoing against the company or its directors, officers or employees.
Our team is highly trained and knowledgeable in responding to urgent matters and managing the ever-growing electronic discovery and disclosure and have substantial experience in advising in respect of public and media scrutiny.
