In three decisions handed down on January 16, 2012, Davies Ward Phillips & Vineberg LLP had another motion for authorization to bring a class action dismissed, this time for three Montréal furniture retailers—Brault & Martineau Inc., Corbeil, and Sears Canada—involving the sales of extended warranties. The case involved seven retailers in all, including The Brick, Bureau en gros, Centre Hi-Fi and Stéréo Plus.
The issue in all of the cases was essentially a merchant’s obligation, before June 30, 2010, to inform consumers of the existence of the existing legal warranty before proposing the purchase of an extended warranty.
